Former Chief Justice Willy Mutunga Wants to Head Commission of Inquiry on Police Violations

Former Chief Justice Willy Mutunga says that he is ready to head a commission of inquiry that would investigate the use of brutal force by police on citizens.

In a post via his Twitter handle, Dr Mutunga offered himself for the role after the unfolding of circumstances surrounding the arrest of National Super Alliance (NASA) strategist David Ndii on Sunday night.

“Hearing Mrs Ndii narrate her pain and her quest for rights reminds me of the trauma my family went through in 1982-3. I can feel the pain of this family. I would really love to chair a Commission of Inquiry into these police violations under the auspices of the Off of Former CJ,” he tweeted.

“The police are blatantly violating Article 238 of the Constitution. They are tarnishing our justice system. The government should value Dr. Ndii’s critiques. He openly exercises his rights. His rights must be protected. And the rights of his family, too,” he said in another tweet.

Ndii was apprehended by seven Flying Squad and the Special Crimes Prevention Unit officers at the Diani Leopard Beach hotel, where he had booked a room for his family.

Speaking on Monday, his wife Mwende said: “Seven officers came two were armed with guns. The approached my husband as he was together with our daughter heading to the dining room.”

“They approached him and said they wanted to have a word with him. After knowing that they were officers, he requested for my phone since he was not carrying any and made some calls before the officers drove (him) away.”

Ndii was released later on a police bond under instructions from the Director of Public Prosecution Keriako Tobiko.

    Who will represent those who were attacked by violent demonstrators, cars burnt, property looted or destroyed, businesses inconvenienced? We need justice on both sides.

      I agree with you there @Onesmus. Mutunga brings up the subject police highhandedness just because a high profile individual like Ndii was on the receiving end. Mutunga, as learned and experienced as he is only sees fault in the police, and none on the inciters. Those who lost their livelihoods, Mutunga, also deserve representation, and it is not the police that took it…

    Mr. Muting, please be advised that thugs carrying stones and rungus openly attacking police officers, motorists and looting businesses under the guise of peaceful protesters are criminals that even a commission of inquiry cannot protect. Just look at our so called protesters in action, assume such a picture is happening any where in western nations and tell us what you think their police officers would do. There would be many dead and mass arrests. Even Nyong’o called them hooligans, thugs and criminals and banned such protests in Kisumu.

    As usual another former big wig looking for his next pay check.What happended to early retirement.While I agree that police need to be investigated and charged for their brutality recycling “has beens” is not the answer.Give this job to the youth and for once let them do the job without interference.For those whose property was destroyed let them claim damages that is what insurance is for.Property can be relplenished and buildings rebuilt however lives lost cannot be recovered let us stop equating the two.Those people who lost property get back to work it is not like some people worse off can raise the dead.

    Are we going to investigate the role NASA principles played by calling the demonstrations and failing to tame the demonstrators, the parents of the youngster who was shot since the parents should have known the outcome of such NASA events based on the history of their demonstrations, something should be done, however police is not the only organ that was at fought here. Peaceful demonstrations are allowed by the constitution, but looting and stabbing innocent people going about their business is not constitutional.
