Supreme Court Judge Smokin Wanjala Explains His Absence During the Reading of Detailed Judgement

Supreme Court judge Justice Smokin Wanjala has shed light on his absence at the bench during the reading of the detailed verdict on the presidential election petition on Wednesday last week.

Speaking in an interview with the Nation moments after landing at the Jomo Kenyatta International Airport on Sunday night, Justice Wanjala said he missed the important court session because he accompanied his daughter, who was being enrolled to City University of London, in the United Kingdom to study Actuarial Science.

“This is a trip that was planned long before the general elections,” said the judge who went on to mention that his ticket was issued by Touch World Safaris.

Justice Wanjala was among the four apex court judges, who ruled in favor of overturning the August 8th presidential election. Others were Chief Justice David Maraga, Deputy Chief Justice Philomena Mwilu and Justice Isaac Lenaola.

Justice Wanjala was, however, absent on September 20 when the court delivered the detailed judgement. In his introductory remarks Chief Justice Maraga excused Justice Wanjala saying je had travelled out of the country.

A section of Kenyans have been demanding to know why Justice Wanjala could not postpone his travel for a duty of such importance. A section also raised queries on whether his absence meant departing from the majority judgment.

Wanjala, however, clarified the matter and dismissed talks that he had departed from his earlier decision.

“Ours is a sick society where all sorts of idlers and busybodies create and feed rubbish to an ever gullible public,” Justice Wanjala responded to the innuendoes.

    Atlas you can miss an important court ruling to attend to your daughter being enrolled in a university in London. Did the school know that you are supreme judge? that this ruling could and can cause serious violence to include death ? did that school know that school may have to close because of you compromised judgement? do you know that some people have lost business and some lack food on their tables because of your judgement? You were elected in office and one country;d always reschedule so stop your rubbish nonsense excuses. It would have made not difference your absence spoke volumes., Bure kabisa and for we care go back to London and be with your daughter,. This is the job that is paying for your bread and butter ., so stop your nonsense

    @Annonynmous, you are a damn fool and your arguments are always naively partisan. Perhaps you have never heard of the expression “Duty or business before pleasure.” Your incompetent and irrational judge chose pleasure before supreme duty. If he could put a simple college trip for his daughter ahead of matters of such enormous national importance, then it clearly means that he doesn’t have the slightest clue of the immense responsibility of being a justice in the apex court in our Republic. The judgment in a case of such a high magnitude could leave the country burning worse than in 2007/08 PEV; and as such ought to have been taken much more seriously than a leisure trip to London which could have either been made ahead of Septmber 20 or delayed to September 21. Most common Wananchi often reschedule their flights depending on circumstances which are purely personal and of no public or national importance. So, why couldn’t this incompetent Justice of the Supreme Court do likewise on a case of such national importance? It doesn’t matter whom the verdict favored – Uhuru or Raila – what is vitally important is that Supreme Court justices must fully understand their roles and responsibilities vis-a-vis peace and stability in our Republic. Giving a flimsy, self-serving excuse doesn’t hold any water — the CJ also failed in his duties and responsibilities by accepting such a silly grade school level excuse. Smokin Wanjala had several viable alternatives available to him — travel before September 20; travel after September 20; the mother and/or any other family member could have accompanied his daughter; or the student could have travelled alone. Instead, he foolishly decided to be AWOL on a case of such national magnitude and with major national implications. That was neither ethical nor patriotic …. and this self-serving Justice ought to be ashamed of himself. If he was not given a privilege to serve our Republic in the Supreme Court, perhaps he couldn’t have funds to educate his daughter in London nor to have such a large entourage to escort her as if she were a 13-year old Royal Princess! Shame on you Smokin and any fool supporting or trying to justify such negligence and delegation of supreme duties!!

    Stop with your insults.Family is more important for this man than duty to his country. Not everyone is as backward as you are .You got NASWAD and we will do it again on the 26th .PS I am not in the habit of arguing with idiots I earned my degrees note the plural from reputable universities .

      There some family matters that are more important than others. We are not talking of a daughter who is sick but a girl who is going to college. Girls of her age take themselves to college. That is how you know your son/daughter is not a baby anymore. Kwanza the looks of the dad is spoiling the chances of the daughter getting a date soon. eti huyu ni baba yako niliona ….smokin….waaa….we might get children that look like him…
