Nairobi County Assembly Speaker Beatrice Elachi has vowed to fight her impeachment in the corridors of justice even if it means going “all the way to the Supreme Court.”
Speaking moments after her impeachment, Elachi said the sitting Members of the County Assembly used to remove her from office was convened to discuss the state of Nairobi and not her ouster.
She further accused the Ward Representatives of maliciously amending the standing orders in the last minute in a bid to throw her out of the House.
Ms Elachi has since obtained conservatory orders from the Employment and Labour Relations Court blocking her removal from office pending the hearing and determination of her petition.
The petition that lists the Nairobi City County Public Service Board and the Nairobi City County Assembly as respondents has been certified as urgent. She also secured conservatory orders stopping the Assembly from appointing her replacement.
“Pending the hearing and determination of this Notice of Motion, a Conservartory Order do issue prohibiting the respondents, their members or any person acting under their behest and direction, from interfering with the execution of the Petitioner of her duties current as the Nairobi City County Assembly Speaker, or otherwise howsoever debating, deliberating upon, or removing from office the Petitioner as the office of the Speaker, Nairobi City County Assembly,” reads the court papers.
“Any purpoted decision to impeach the Petitioner as such Nairobi City County Speaker executed as the 2nd Respondent on the 6th September 2018 be stayed pending the determination of the petition herein.”
