Attorney-General Paul Kihara Kariuki is set to file an appeal against High Court ruling that ordered Interior Cabinet Secretary Fred Matiang’i and Immigration Principal Secretary Gordon Kihalangwa to compensate Kenyan-Canadian lawyer Sh7.2 million for illegal deportation.
Citizen Digital reports that AG Kihara filed a notice of appeal immediately after Justice Chacha Mwita’s verdict on Friday and is set to file a substantive appeal on Monday morning.
Justice Mwita ruled that the two violated the self-declared National Resistance Movement (NRM) general’s rights in declaring him a prohibited immigrant and bundling him out of the country.
He also ruled that Miguna did not lose his Kenyan citizenship when he acquired a Canadian passport in 1988.
“…The government’s deduction to cancel Miguna Miguna’s passport and declaring him prohibited immigrant is unconstitutional and is hereby declared null and void,” reads the ruling.
“I find and hold that he did not lose his citizenship upon acquiring a Canadian passport,” declared Justice Mwita.

Unless Miguna lives under a different set of rules, there’s no way they are letting him back in. Many of us have had to reapply for the restoration of our Kenyan passport because we acquired a foreign one prior to the 2010 adoption of the new constitution. Miguna is no more special than the rest of us.

I am with the government on this. Miguna Miguna renounced his Kenyan Citizenship for Canadian Citizenship. The Law is clear for those who want to acquire dual Citizenship. Miguna refuses to follow that law and want to become a dual citizen through circumventing it with help from corrupt Judges such as Mwita. As somebody who has declared himself a leader of a banned terrorist organization, NRM, Miguna is a serious security threat to the stability of Kenya and that of Eastern Africa as whole because a destabilized Kenya would bring the whole of that region down. No wonder European Union has placed him on terror watch list. Miguna’s two pending rape cases in Canada also puts his application for Kenyan Citizenship automatically on hold because if he is convicted on any of them he would be required to register as a sex offender in Canada and Kenya does not admit sex offenders in the country
