Tussle for Multi-Million-Shilling Estate Belonging to Kisumu Governor Anyang Nyongo's Father Drags to Appeals Court

The tussle for a multi-million-shilling estate left behind by Kisumu Governor Anyang’ Nyong’o’s late father Hesbone Shimei Nyong’o has dragged to the Appeals Court.

Two separate cases have been filed at the  country’s second highest court; one by Governor Nyong’o and his sister and another by their nephews.

The Governor’s nephews have moved to the Appellate Court after their uncle (Governor Nyong’o) and aunt (Risper Nyagoy) failed to produce books of accounts as ordered by the High Court in October.

Prof Nyong’o’s nephews, Kenneth Okuthe and Geoffrey Omondi had moved to court after the Governor and his sister failed to include their names and those of other relatives in the list of beneficiaries of the estate.

On October 11th, Kisumu High Court judge Thripsisa Cherere ruled in favor of Okuthe and Omondi and  ordered the Governor and his sister to include them in the list of beneficiaries.

In her ruling, the judge revoked the administrative letters that made Prof Nyong’o and Dr Nyagoy the sole controllers of the estate and appointed Okuthe as a co-administrator. The two were also ordered to include their sisters’ children as beneficiaries of the estate.

The nephews have filed a case at the Appeals court after the two failed to table books of account within 45 days as ordered by the High Court.

On the other hand, Governor Nyong’o and Dr Nyagoy have filed a case at the Appellate court seeking to suspend the execution of orders given by the lower court.

Shimei’s estate include 100 acres of land in Miwani, apartments on Jogoo Road in Nairobi, plots of land in Manyatta, Tamu, Milimani estate and East Rata in Kisumu.

The two appeals will be heard on December 19th.
