Miguna Miguna Says He Will Reject CAS Appointment

Lawyer Miguna Miguna says he would reject President Ruto’s offer for a Chief Administrative Secretary (CAS) position, stating that the office is illegal.

Speaking during an interview with NTV, Miguna said he is open to taking up a position in Ruto’s administration, but insisted he would reject certain appointments.

“It depends on which government appointment. There are things I would not take. The appointment would have to be proposed then I would say whether to take it or not. There are so many things I would not take like the illegal CAS position,” said Miguna, who returned to the country on Thursday following his deportation in 2018. 

Last week, the Employment and Labor Relations Court suspended the creation of the CAS position in the public service pending the hearing and determination of an application by the Law Society of Kenya (LSK).

LSK argues that the lack of clarity on the intended office denies the public the opportunity to make comments on the possibility of the duplication of duties between the Principal Secretary and the Chief Administrative Secretary.

The matter will be heard on October 24th.

Former President Uhuru Kenyatta created the CAS position in 2018, but the High Court declared it unconstitutional in 2020 as no public participation was done prior to its creation.

Last month, President Ruto proposed that the position is created under the public service and have all provisions of the law, including the public participation requirement met.

As a result, the PSC invited members of the public to submit their views on the creation of the CAS position, an exercise that was concluded on October 6th.
